The TPTS Spin-to-Win game (the “Game”) is governed by these official rules (the “Official Rules”) which govern all matters related to the Game and those participating in the Game at The Pharmacy Technician SocietySM (“TPTS”) exhibit booth (the “TPTS Booth”) at the 2024 Midyear Clinical Meeting and Exhibition in New Orleans, Louisiana (the “Meeting”). By participating in the Game, you agree to these Official Rules, which are a contract, so read them carefully before entering. Without limitation, this contract includes indemnities to the Game Entities (as such term is defined below) from you and a limitation of your rights and remedies. The Game shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein and the decisions of the Sponsor, including the interpretation of these Official Rules and its exercise and discretion, which will be final and binding in all respects.
ELIGIBILITY
The Game is open only to all legal residents of the fifty (50) United States and the District of Columbia (excluding Puerto Rico and all other U.S. and foreign territories and possessions, and wherever else prohibited or restricted by law) who are at least eighteen (18) years old (or the age of majority in their respective state or jurisdiction) or older at the time of entry. All employees of The Pharmacy Technician Society (“TPTS” or “Sponsor”) and its respective affiliates, subsidiaries, divisions, directors, officers, fulfillment and advertising and promotion agencies (“Game Entities”) and their immediate family members (spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and/or those persons who reside in the same household as any employee or immediate family member of TPTS or Game Entities are not eligible to enter or win. The Game is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited or restricted by law.

ENTRY PERIOD
The Game will occur at the TPTS Booth during its operating hours (Monday, December 9, 11:00 a.m. – 3:00 p.m., Tuesday, December 10, 11:00 a.m. – 3:00 p.m., and Wednesday, December 11, 11:00 a.m. – 2:00 p.m.) (the “Game Period”). All times are CST (the “Game Period”). Sponsor reserves the right to extend or shorten the Game Period at its sole discretion.
TO ENTER
No advance entry is necessary; enter in-person at the Meeting. Visit the TPTS Booth at the Meeting to participate. Limit one (1) spin per person per day during the Game Period. One Grand Prize winner will be drawn at the end of each day during the Game Period. The winners will be contacted via email to collect their prize.
Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be returned.
WINNER SELECTION: Every spin will win a prize. One (1) grand prize will be awarded per day during the Game Period. Grand prize winners will be notified during the Meeting and prize redemption instructions will be emailed to such winners by Sponsor.
WINNER NOTIFICATION AND RELEASES: Sponsor will attempt to notify the Grand Prize winners in-person at the Meeting via e-mail correspondence. If a potential winner: (a) does not respond within two (2) business days after the first attempted contact from Sponsor, (b) is not in compliance with these Official Rules, (c) does not meet the eligibility requirements, or (d) declines the prize, he or she will be disqualified and a new winner will be drawn from entries. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. TPTS and its respective affiliates, subsidiaries, directors, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Game, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Game is unlawful and subject to possible legal action by TPTS. TPTS reserves the right to terminate, suspend or amend the Game, without notice, and for any reason, including, without limitation, if Sponsor determines that the Game cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond ASHP's control corrupt the administration, security, fairness, integrity or proper play of the Game. In the event any tampering or unauthorized intervention may have occurred, TPTS reserves the right to void suspected entries at issue. TPTS and its respective affiliates, subsidiaries, directors, officers, employees, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
PRIZES/ODDS: Three (3) grand prizes are available. The grand prizes are three (3) thirty (30) ounce Yeti Rambler tumblers, each with an approximate retail value of $40.00. The total approximate retail value (“ARV”) of the three grand prizes is $120.00. In addition to one (1) entry ticket into a daily drawing for one of the grand prizes, a smaller prize, of nominal value, will be awarded for every spin. Smaller prizes consist of: a TPTS lanyard, a TPTS lapel pin, a TPTS pen, or a TPTS sticker. Each winner is responsible for all taxes and fees associated with such winner’s prize receipt and/or use. Sponsor will report any individual winnings over $600.00 (in cash or fair market value of goods or services) in a calendar-year period to the Internal Revenue Service. The winner will receive a Form 1099 from Sponsor if Sponsor reports any winnings to the Internal Revenue Service. The prize may not be exchanged for cash or any other consideration. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right in its sole discretion to substitute the prize with another prize of greater or equal value. Any difference between advertised and actual value will not be awarded. Odds of winning a prize depend on the number of eligible entries received prior to the drawing.
LIMITATIONS ON LIABILITY AND DISPUTES
Entrants agree to indemnify, release and hold harmless TPTS, the Game Entities and its respective affiliates, subsidiaries, and their directors, officers, employees, agents, representatives, fulfillment and advertising and promotion agencies, and all their respective officers, directors, employees, agents, representatives from any liability, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession of the prize resulting from participating in this Game or any Game-related activity and to release all rights to bring any claim, action or proceeding against Game Entities. Game Entities will have no liability whatsoever for failure to supply a prize or any part thereof, by reason of any acts of God, any severe weather, hurricane, flood, fire, war, transportation interruption of any kind, or any other cause beyond their control. U.S. laws govern this Game. Entrant hereby acknowledges that ASHP and Game Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize provider that may be sent along with a prize.
BY ENTERING THE GAME, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GAME, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.
By participating, each Contestant grants TPTS and its respective affiliates, subsidiaries, and their directors, officers, employees, agents, representatives, fulfillment and advertising and promotion agencies, and all their respective officers, directors, employees, agents, representatives permission to use his/her name, likeness, picture or comments for publicity purposes, as deemed appropriate by TPTS, without payment of additional consideration.

MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Game-related materials, privacy policy or other terms and conditions on the TPTS website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
