The ASHP Experience Midyear Madness Contest (the "Contest") is governed by these official rules (the "Official Rules") which Official Rules govern all ASHP Experience Midyear Madness Contest appearing at the official American Society of Health-System Pharmacists ("ASHP" or "Sponsor") Experience Booth at the 2022 Midyear Clinical Meeting and Exhibition in Las Vegas, Nevada (the "Meeting"). The Contest is sponsored by ASHP. ASHP and its representatives are not responsible for the fulfillment of other Contest(s) that may occur on other pages or at the Meeting. By participating in the Contest, each Contestant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by the Sponsor, is final in all respects. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
ELIGIBILITY
The Contest is open only to those individuals who are legal residents of the 50 United States, the District of Columbia, and Puerto Rico and are eighteen (18) years of age or older at the time of entry. Sponsor has the right to verify the eligibility of each Contestant. Employees of ASHP, its respective affiliates, subsidiaries, directors, officers, advertising and promotion agencies, prize suppliers, including any vendors providing services in connection with this Contest (collectively, the "Sponsor Affiliates") and their immediate family members (spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and/or those living in the same household of Sponsor or Sponsor Affiliates are not eligible to enter or win. To participate, you must (i) attend Midyear, (ii) compete in the designated tournament rounds, (iii) be present at the final basketball round on Wednesday, December 8, 2022, and (iv) have a valid email address (each an "Contestant"; and, collectively, the "Contestants"). A valid email address is defined as an email address assigned to a natural person by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. By participating, Contestants agree to be bound by these Official Rules and the decisions of Sponsor.
CONTEST PERIOD
The Contest will occur at the ASHP Experience Center during Exhibit Booth operating hours Monday, December 5, 11:00 a.m. – 3:00 p.m., Tuesday, December 6, 11:00 a.m. 3 p.m. and Wednesday, December 7, 11 a.m. – 2 p.m., respectively. Round 1 will take place on Monday on Tuesday, and Round 2 and Round 3 will take place on Wednesday, beginning at 12 p.m., in person at the ASHP Experience Center. All times are in PST (the "Contest Period"). All scores must be achieved during the Contest Period. Sponsor reserves the right to extend or shorten the Contest Period at its sole discretion.
TO ENTER: No advance entry is necessary; enter in-person at the Meeting. Visit the ASHP Experience booth at Midyear and participate in the basketball game. Your score will be recorded by the basketball scoring system. All Contestants must be present and ready to participate at the designated court at the time designated by ASHP. Each round, as specified below, will be determined at the Meeting by ASHP.
ROUND 1
Qualifiers: In the qualifying round, each Contestant will play in dual matches to score as many points as possible to beat the clock in 45 seconds, which will be visible to all Contestants with a buzzer signifying that time has run out. Contestants may play multiple games in Round 1; their highest score will be used in the rankings.. The Top 8 Contestants with the top scores will advance to Round 2. If any of the Top 8 Contestants chooses not to move on in the Contests or does not appear at the designated time for Round 2, Sponsor will continue down its list of contestants notifying the next highest scoring individual of the opportunity to advance until eight contestants are available for Round 2.
ROUND 2
The Top 8: The Top 8 Contestants from Round 1 will face off in Round 2 to score as many points as possible to beat the clock in 45 seconds, which will be visible to all Contestants with a buzzer signifying that time has run out. The Top 4 Contestants with the top scores from Round 2 will advance to the final Round 3.
FINAL ROUND 3
Head to Head Matchup: One final round of the top 2 Contestants will face off to score as many points as possible to beat the clock in 45 seconds, which will be visible to all Contestants with a buzzer signifying that time has run out. The top Contestant with the highest score will be deemed the winner and will potentially win a prize.
PRIZE: One (1) prize will be awarded during the Contest Period. The prize is a Nintendo Switch 32GB Console with an approximate retail value of $300.00. ASHP is not responsible for defective items and does not guarantee or warranty any item offered as a prize.
WINNER SELECTION: One (1) winner will be determined on Wednesday, December 11 during the final round of play. Announcement of winner will take place at the Meeting and prize redemption instructions will be be via emailed to such winner by Sponsor.
WINNER NOTIFICATION AND RELEASES: Sponsor will attempt to notify the winner in-person at the Meeting or via e-mail correspondence. If a potential winner: (a) does not respond within two (2) business days after the first attempted contact from Sponsor, (b) is not in compliance with these Official Rules, (c) does not meet the eligibility requirements, or (d) declines the prize, he or she will be disqualified and the prize will be awarded to the runner-up Contestant with the second highest score based on the results of the Final Round 3. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. ASHP and its respective affiliates, subsidiaries, directors, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by ASHP. ASHP reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond ASHP's control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, ASHP reserves the right to void suspected entries at issue. ASHP and its respective affiliates, subsidiaries, directors, officers, employees, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH CONTESTANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS ASHP AND ITS RESPECTIVE AFFILIATES, SUBSIDARIES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, ADMINISTRATORS, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT CONTESTANT'S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. ASHP AND ITS AFFILIATES AND SUBSIDIARIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. ASHP AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST PUBLICITY.
By participating, each Contestant grants ASHP permission to use his/her name, likeness, picture or comments for publicity purposes, as deemed appropriate by ASHP, without payment of additional consideration.
