By entering the scavenger hunt, you agree to these ASHP 80-year Anniversary MCM 2022 Scavenger Hunt Official Rules (the "Official Rules"), which are a contract, so read them carefully before entering. Without limitation, this contract includes indemnities to the scavenger hunt parties from you and a limitation of your rights and remedies. The scavenger hunt shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein and the decisions of the Sponsor, including the interpretation of these Official Rules and its exercise and discretion, which will be final and binding in all respects.
ELIGIBILITY
ASHP 80-year Anniversary MCM 2022 Scavenger Hunt is open only to all legal residents of the fifty (50) United States (excluding Puerto Rico) and the District of Columbia who are at least eighteen (18) years old (or the age of majority in their respective state or jurisdiction) or older at the time of entry and who are attendees of the 2022 ASHP Midyear Clinical Meeting and Exhibition in Las Vegas, Nevada at the time of entry. All employees of the AMERICAN SOCIETY FOR HEALTH-SYSTEM PHARMACISTS ("ASHP" or "Sponsor") and its respective affiliates, subsidiaries, divisions, directors, officers, fulfillment and advertising and promotion agencies ("Entities") and their immediate family members (spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and/or those persons who reside in the same household as any employee or immediate family member of ASHP or Entities are not eligible to enter or win. The scavenger hunt is subject to all applicable federal, state and local laws and regulations. Participation constitutes the participant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the scavenger hunt. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited or restricted by law.

ENTRY PERIOD
The scavenger hunt begins on December 4, 2022, at 7:00 a.m. Pacific Time ("PT") and ends on December 8, 2022, at 2:00 p.m. PT (the "Scavenger Hunt Period"). Sponsor's database computer is the official timekeeping device for the Scavenger Hunt.
- HOW TO ENTER:
- During the Scavenger Hunt Period, participants will visit the Mandalay Bay Convention Center a review a series of nine (9) ASHP 80-Year Anniversary timeline meter boards for each decade containing ASHP milestones from that decade.
- Use your mobile phone device to scan the designated QR code leading to a quiz form with multiple choices at each timeline meter board.
- Answer each multiple-choice question using the timeline meter board as a reference.
- If all nine (9) multiple-choice questions are answered correctly, you will be entered into a random drawing to win the grand prize.
Limit one (1) entry per person during the Scavenger Hunt Period regardless of method of entry. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed as the registrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be returned.
CONDITIONS OF ENTRY
As a condition of participating in the scavenger hunt, winner gives consent for Sponsor to obtain and deliver relevant information to third parties for the purpose of administering this scavenger hunt and complying with applicable laws, regulations and rules. Any information participants provide to Sponsor may be used to communicate with participant in relation to this scavenger hunt. By entering the scavenger hunt, each participant consents to the use of participant's name, city and state of residence, statements, voice, and likeness by ASHP and its designees for advertising and promotional purposes online and offline in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law, as applicable.
WINNER SELECTION
All participants who respond to all nine (9) multiple-choice questions correctly and submit their responses timely by the stated designated time will be entered into the random drawing to win the grand prize. On December 12, 2022 at 8:00 a.m. PT, the complete list of successful participants will be randomly assembled and one (1) participant will be randomly selected to win the prize of all valid entries received. The participant will be contacted using the email address provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules) within 30 days of the conclusion of the 2022 MCM at the Mandalay Bay Convention Center. Sponsor's decisions as to the administration and operation of the scavenger hunt and the selection of the potential winner is final and binding in all matters related to the scavenger hunt. Non-winning entries from one drawing do not carry over into subsequent drawings.
VERIFICATION OF POTENTIAL WINNER
The potential winner must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. As a condition of being awarded any prize, the winner may (in Sponsor's sole discretion) be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other legal, regulatory, or tax-related documents required by Sponsor in order to claim a prize. By submitting tax-related documents you hereby consent to: (i) Sponsor holding and processing any information about you, that you may provide to Sponsor or that Sponsor may acquire as a result of submitting such tax-related documents; (ii) the transfer to Sponsor of all information or any part thereof in the tax-related documents to complete the prize request; and (iii) the transfer by Sponsor to the Internal Revenue Service of any information or any part of thereof, as necessary for reporting obligations, related to any winnings from Sponsor of at least $600 in a calendar-year period. If a potential winner of any prize cannot be contacted, fails to sign and return any affidavit or document required by Sponsor within the required time period (if applicable), or if the prize notification is returned as undeliverable, the potential winner forfeits the prize. In the event that a potential winner of a prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
PRIZE/ODDS
One (1) prize is available. The prize consists of: one (1) 32g Nintendo Switch with Joy-Con Controller. The total approximate retail value ("ARV") of the prizes are $299.00. The winner is responsible for all taxes and fees associated with prize receipt and/or use. Sponsor will report any individual winnings over $600.00 (in cash or fair market value of goods or services) in a calendar-year period to the Internal Revenue Service. Winner will receive a Form 1099 from Sponsor if Sponsor reports any winnings to the Internal Revenue Service. The prize may not be exchanged for cash or any other consideration. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right in its sole discretion to substitute the prize with another prize of greater or equal value. Any difference between advertised and actual value will not be awarded. Odds of winning a prize depend on the number of eligible entries received prior to the drawing.
LIMITATIONS ON LIABILITY AND DISPUTES
Participants agree to indemnify, release and hold harmless ASHP, the Entities and its respective affiliates, subsidiaries, and their directors, officers, employees, agents, representatives, fulfillment and advertising and promotion agencies, and all their respective officers, directors, employees, agents, representatives from any liability, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession of the prize resulting from participating in this scavenger hunt or any scavenger hunt-related activity and to release all rights to bring any claim, action or proceeding against Entities. Entities will have no liability whatsoever for failure to supply a prize or any part thereof, by reason of any acts of God, any severe weather, hurricane, flood, fire, war, transportation interruption of any kind, or any other cause beyond their control. U.S. laws govern this scavenger hunt. Participant hereby acknowledges that ASHP and Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize provider that may be sent along with a prize.
BY ENTERING THE SCAVENGER HUNT, PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SCAVENGER HUNT, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4)PARTICIPANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the scavenger hunt, shall be governed by, and construed in accordance with, the laws of the State of Maryland, United States of America, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland, United States of America or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland, United States of America.
MISCELLANEOUS
The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, Sponsor has sole and absolute discretion. Participants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any scavenger hunt-related materials, privacy policy or other terms and conditions on the ASHP website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor's sole and absolute discretion.
